NY Times: Where Faith Abides, Employees Have Few Rights

This lengthy story discusses an interesting question in constituional law — does the First Amendment prevent government from regulating in any way employment by the religious sector? And if not, what are the limits to such regulation?

I also though am struck by another question that is not legal… how can the churches discussed in this story possibly justify their treatment of their employees from a faith perspective? To imagine a Catholic order kicking out a nun who is diagnosed with breast cancer, so as to avoid paying her medical bills…. I just can’t imagine how the church could justify this kind of unchristian treatment.
